Applicants
One of the most common temporary visas is the Temporary Business Long Stay (subclass 457) visas. Firstly, you must be sponsored by an Australian business that is willing to undertake the sponsorship obligations and offer you full time employment in an approved skilled occupation. You may then be eligible for this visa, which will allow you to work in Australia for up to 4 years. Your family can also relocate to Australian with you. If you are in a MODL occupation, then we may be able to arrange for your sponsorship, prior to your permanent visa approval.

Australian Sponsors
Due to the skills shortages, like many other Australian employers, you may have found difficulties in recruiting locally.  With the Temporary Business Long Stay (subclass 457) visa you can have access to skilled workers from overseas.

As a first step, you will have to be approved as a business sponsor by the Department of Immigration and Citizenship (DIAC).  The position you wish to fill must be on the list of approved occupations that meet the minimum skill level requirement and be paid at least the minimum salary threshold set by the Department of Immigration and Citizenship.  Your overseas skilled worker must also have relevant qualifications and/or experience in their approved occupation.  As a business sponsor you must also satisfy all other DIAC requirements including regular monitoring.  If you are looking for employees, kindly register your needs with us by sending a brief email.

 

Permanent Visas
• Employer Nomination Scheme (subclass 121/856) and
• Regional Sponsored Migration Scheme (subclass 119/857)

The Employer Nomination Scheme (ENS) and Regional Sponsored Migration Scheme (RSMS) are for Australian companies that require the skills of overseas workers and who are willing to sponsor the overseas worker for Australian permanent residency.  The company will have to meet DIAC requirements and demonstrate its ability to meet sponsorship obligations. There are two steps to the Employer Nomination Scheme –

1. Nomination Application – the sponsoring company has to be approved by the Department of Immigration and Citizenship, and
2. Visa Application – the visa applicant has to meet his/her requirements to be granted a permanent visa.

If you are applying for the RSMS, you must first seek approval by a Regional Certifying Body.
The requirements of an ENS include:

  • The nominated occupation must be on the ENSOL (Employer Nomination Skilled Occupation List);
  • The position must be a full time position for at least 3 years;
  • The salary for the nominated position must meet the minimum salary threshold;
  • The applicant must be under 45 years of age (unless there are exceptional circumstances );
  • The applicant must have at least vocational English (unless DIAC agrees to waive this requirement), and
  • The applicant must satisfy one of the following three:
    i) Worked on a 457 visa in Australia for at least 2 years of which at least one year is with the nominator employer OR
    ii) Have a positive skills assessment from a designated Assessing Authority together with at least 3 years of post qualification work experience OR
    iii) A base annual salary of more than AUD 165,000.00.
